High Court Decisions

The High Court has made the following decisions about the Electricity Authority's compliance function.

On 20 November 2020 the High Court dismissed an appeal by Intellihub Limit against the decision of the Electricity Authority. The Court found that the Electricity Authority was justified in its decision and acted reasonably.

On 21 June 2018 the High Court issued its decision on an appeal and judicial review lodged by City Financial Investment Company (New Zealand) Limited. The appeal and judicial review related to the Electricity Authority’s decisions on allegations that Transpower New Zealand Limited had breached certain provisions of the Electricity Industry Participation Code 2010. The Code provisions relate to changes made to the operation of the HVDC link.

The High Court dismissed both the appeal and the judicial review.

On 19 June 2017, the High Court found that the Rulings Panel has no jurisdiction to hear Solar City’s complaint against Unison relating to Unison’s retail consumer tariff for consumers with distributed generation.
